General Terms and Conditions

§ 1 Scope of the Contract
The following terms govern the contractual relationship between the seller

and to the respective buyer on the eGun online platform.

§ 2 Vertragsgegenstand
The subject of the respective contract is the sale of goods by the seller to the buyer on the eGun sales platform, in particular the sale of hunting & sport weapons & hunting optics.

These goods are offered by the seller either via his eGun-Shop as shop items or as general auction items. General auction items are visible both on the general eGun-Website and in the seller's eGun-Shop.

The product listings posted on the general eGun website or in the seller's eGun shop are binding offers from the seller to conclude a contract for the respective item.

§3 Formation of the Contract

(1) The subject matter of the contract is the sale of goods.

(2) If an item is listed by us on eGun, the activation of the offer page on eGun constitutes a binding offer to conclude a purchase contract under the conditions specified in the article page.

(3) For the conclusion of the contract, the eGun General Terms and Conditions apply, in particular the provisions under "Conclusion of a Contract", a corresponding link is located at the bottom of each eGun page.
The conclusion of the contract is regulated as follows:

"Conclusion of a Contract"
Users who place an item on the eGun website for online auction are making a binding offer. The seller sets a deadline during the listing process within which the offer can be accepted by a bid. The offer is accepted when a bidder submits a bid. The bid expires if another bidder submits a higher bid. At the end of the auction period, a contract is concluded between the seller and the highest bidder for the purchase of the item listed by the seller on eGun. The agreed-upon price is understood to be a gross price (i.e., including VAT). There is also the possibility to offer items on the eGun website with the "Buy Now" (fixed price) option. In this case, a contract is concluded by the immediate purchase of the item. This purchase is independent
from the end of the bidding period. This option is only available as long as the item has not yet been bid on. If a contractual processing between the seller and bidder does not succeed, eGun will offer the item to the second highest bidder within an automatic process, so that the contract can still be successfully concluded.

(4) Clicking on the "SofortKauf", "Jetzt Bieten", or "Vorschlag" buttons on the article pages does not yet lead to binding contractual declarations. The customer, moreover, also has the possibility after that to review their entries and to correct them or cancel the purchase via the "Zurück" button of the internet browser. Only with the submission of the binding contractual declaration does this possibility no longer exist. (5) The processing of the order and the transmission of all information required in connection with the conclusion of the contract is done via email, partly automatically. §4. Vertragssprache / Vertragstextspeicherung

(1). The contract language is German.

(2). The complete contract text will not be stored by us. Before submitting the order, the contract data can be printed or saved electronically using the browser's print function. After receiving the order from us, the order data, the legally required information for distance contracts, and the General Terms and Conditions will be sent to you again by email.

§ 5 Widerrufsrecht

You have the right to revoke this contract within fourteen days without giving any reason.
The revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has/has taken possession of the goods. In the case of a contract for multiple goods that you have ordered in a single order and which are delivered separately, the revocation period is fourteen days from the day on which you or a third party named by you, who is not the carrier, has/has taken possession of the last item.

Withdrawal consequences

If you withdraw from this contract, we will reimburse all payments we have received from you, including delivery costs (except for the additional costs arising from the fact that you have chosen a different type of delivery than the cheapest standard delivery offered by us), immediately and no later than fourteen days from the day on which the notice of your withdrawal from this contract is received by us.

For the repayment, we will use the payment method you used for the original transaction, unless otherwise expressly agreed with you; in no case will we charge you any fees for this repayment.
We can refuse the refund until we have received the goods back or until you have provided proof that you have returned the goods, whichever is earlier. You must send back the goods or hand them over to us immediately and in any event no later than fourteen days from the day on which you inform us of the revocation of this contract. We bear the costs of returning the goods. You are only liable for any loss in value of the goods if this loss in value is due to handling the goods in a way that is not necessary to check their condition, properties, and functions.

 

Exclusion or Expiration Reasons:

- for the delivery of goods that can spoil quickly or whose expiration date will be exceeded soon

The right of withdrawal expires prematurely for contracts

  § 6 Warranty, Liability
The seller's warranty in the event of a defect in the goods and the seller's liability for damages are governed by the statutory provisions.

§ 7 Zurückbehaltungsrecht, Eigentumsvorbehalt

(1) You can only exercise a right of retention if it pertains to claims arising from the same

§ 8 Sale of firearms

(1) When selling goods that are subject to the Weapons Act, we generally only enter into contractual relationships with adult customers. For goods listed in Annex 2 of the WaffG, your weapon authorization is additionally required.

(2) By submitting your order, you confirm that you are at least 18 years old and that your details regarding your name and address are correct. You are obligated to ensure that only you or fully adult persons authorized by you to receive the delivery take possession of the goods. We instruct the logistics service provider entrusted with the delivery to hand over the delivery only to persons over 18 years of age and, in case of doubt, to request the ID card of the person receiving the goods for age verification.

(3) Unless orders are placed by persons under the age of majority, we hereby revoke the contract as a precaution in accordance with § 109 BGB. The fully adult persons who are responsible for minors who have placed orders with false information shall be liable to us in accordance with the statutory provisions for all damages arising from orders made with false information.

 

§ 9 Schlussbestimmungen
On the present General Terms and Conditions and on the respective concluded purchase contract, exclusively German law is applicable.
